These General Terms and Conditions of Sale have been drafted with the same commitment to clarity, transparency and high standards that we bring to every one of our creations and to every relationship with our customers.

These General Terms and Conditions of Sale (hereinafter the "Terms") govern all sales made through the Archibald Distillations online store. Archibald Distillations is the trading name of TOFC, a simplified joint-stock company (SAS) with a share capital of €111,490, registered with the Bordeaux Trade and Companies Register under number 791 242 159 R.C.S. Bordeaux, whose registered office is located at L'Annexe de la Distillerie – 37 rue de Béarn, 33700 Mérignac, France, VAT number FR10791242159.
For ease of reading, TOFC is hereinafter referred to by its trading name, "Archibald Distillations".
These Terms define the conditions under which our non-alcoholic tasting cuvées, our Tonic de Dégustation, and all other products offered for sale through the online store may be ordered, purchased, paid for, delivered and, where applicable, returned.
Their purpose is to clearly and transparently define the rights and obligations of both parties in relation to purchases made through the website.
Please read these Terms carefully before placing an order. By confirming an order, you acknowledge that you have read and accepted these Terms in their version applicable on the date of your purchase.
These Terms may be updated from time to time to reflect changes to our business, our services or applicable legislation. The version published on the website at the time the order is placed shall prevail.
Purpose and Scope
These General Terms and Conditions of Sale apply to all orders placed through the online store at www.archibald-distillations.com for the delivery of products offered by Archibald Distillations in France and in the countries available at the time of ordering.
They define the conditions under which Archibald Distillations sells its products to consumers and, more generally, to non-professional customers.
These Terms shall prevail over any other document unless otherwise expressly agreed in writing by Archibald Distillations.
Placing an order constitutes full and unconditional acceptance of these Terms.

Products
Archibald Distillations offers for sale its non-alcoholic tasting cuvées, its Tonic de Dégustation, as well as the other products presented in the online store.
Each product page describes the essential characteristics of the relevant product, its price, the available formats and, where applicable, useful information regarding serving, storage and delivery.
The photographs, illustrations and other visuals displayed on the website are intended to represent the products as faithfully as possible. Minor differences, including those resulting from photography, screen colour rendering or changes in presentation, shall not give rise to any liability on the part of Archibald Distillations.
Products remain available for purchase for as long as they are displayed on the online store and while stocks last.
Archibald Distillations reserves the right to modify its product range at any time. Such changes shall not affect orders that have already been definitively confirmed.

Orders
Orders may only be placed through the online store at www.archibald-distillations.com.
Before confirming an order, customers are invited to check the accuracy of the information provided, including the selected products, quantities, delivery address and contact details.
Confirmation of an order constitutes a commitment to purchase and acceptance of these Terms.
Once an order has been placed, the customer will receive a confirmation email. The order shall only become final once payment has been successfully validated.
Archibald Distillations reserves the right to refuse or cancel an order for legitimate reasons, including, but not limited to, a previous dispute with the customer, failure of payment, actual or suspected fraud, or where the quantities ordered are clearly incompatible with a purchase intended for personal use.

Product Availability
Products displayed in the online store are offered subject to availability.
Despite the care taken in managing stock levels, a product may exceptionally become unavailable after an order has been confirmed.
In such circumstances, Archibald Distillations will inform the customer as soon as possible and, depending on the situation, may offer:

a refund for the unavailable product(s)

an equivalent product, subject to the customer's prior agreement

or, where possible, delayed shipment
Any refund will be made using the same payment method as that used for the original order, unless otherwise agreed with the customer.

Prices
All prices are displayed in euros (€) and include all applicable taxes (VAT).
Applicable delivery charges are indicated before the order is confirmed.
Where free delivery is offered, the applicable conditions are specified on the online store and apply according to the terms in force at the time the order is placed.
Archibald Distillations reserves the right to modify its prices at any time. However, products will be invoiced on the basis of the prices in force at the time the order is confirmed.

Payment
Payment in full is required at the time the order is confirmed.
The payment methods accepted are indicated on the online store. At the date of these Terms, payment may be made using:

Payments are processed using secure payment solutions.
Archibald Distillations reserves the right to modify the payment methods available through the online store at any time.

Delivery
Each order is prepared with the utmost care by Archibald Distillations before being entrusted to the carrier best suited to the destination country and the nature of the order.
Orders are usually prepared within 24 to 48 business hours and are dispatched from Monday to Friday, excluding public holidays.
Delivery times indicated on the online store are provided for guidance only. They may exceptionally be extended during periods of high demand, temporary closures or as a result of circumstances beyond the control of Archibald Distillations.
Delivery terms, destination countries, applicable shipping charges and estimated delivery times are detailed on the Delivery page of our website and are confirmed before the order is placed.
In accordance with applicable law, if delivery cannot be completed within thirty (30) days from the date of the order, the customer may exercise the rights granted under French consumer law.

Receipt of Your Order
Upon delivery, customers are invited to check the apparent condition of the parcel.
If the parcel has been damaged in transit or if a product has arrived broken, we invite customers to contact Archibald Distillations as soon as they receive their order, either by email at contact@archibald-distillations.com or by telephone on +33 (0)9 84 56 52 29.
To help us process the request as efficiently as possible, customers are encouraged, where possible, to provide photographs.
Every request is carefully reviewed so that the most appropriate solution can be provided as quickly as possible. Depending on the circumstances, Archibald Distillations may replace the affected product(s) or issue a refund.
Responsibility for the products passes to the customer, or to any third party designated by the customer, upon physical receipt of the order.

Right of Withdrawal
In accordance with the French Consumer Code, customers have a period of fourteen (14) days from receipt of their order in which to exercise their right of withdrawal, without having to provide any reason.
To exercise this right, customers must notify Archibald Distillations by email or post before the expiry of the withdrawal period.
Returned products must be complete, unopened, in their original condition and suitable for resale.
Unless otherwise required by law, the cost of returning the products shall be borne by the customer.
Once the returned products have been received and inspected, Archibald Distillations will issue the corresponding refund in accordance with the applicable legal provisions.
In accordance with applicable law, the right of withdrawal does not apply to products that have been opened or unsealed after delivery and which cannot be returned for reasons of health protection or hygiene.

If There Is an Issue with Your Order
Archibald Distillations takes the greatest care in preparing every order and in ensuring the quality of the products offered through its online store.
Should a product prove to be defective, or should any issue be identified upon receipt of the order, customers are invited to contact Archibald Distillations

Every request is carefully reviewed in order to provide the most appropriate solution, in accordance with the applicable legal provisions.
Products sold by Archibald Distillations benefit from the statutory legal guarantees provided under French law, including the legal guarantee of conformity and the warranty against hidden defects.

Intellectual Property
All elements of the Archibald Distillations online store, including but not limited to texts, photographs, illustrations, videos, graphics, logos, trademarks, designs and other content, are protected by applicable intellectual property laws.
Any reproduction, representation, adaptation, distribution or use, whether in whole or in part, without the prior written consent of Archibald Distillations is strictly prohibited.

Force majeure
Archibald Distillations shall not be held liable for any delay in, or failure to perform, all or part of its obligations where such delay or failure results from an event of force majeure as recognised under French law.
Whenever reasonably possible, Archibald Distillations will inform the customer as soon as practicable and will make every reasonable effort to minimise the consequences of such event.

Governing Law and Dispute Resolution
These General Terms and Conditions of Sale shall be governed by and construed in accordance with French law.
Should any difficulty arise in relation to an order, customers are encouraged to contact Archibald Distillations in order to seek an amicable resolution.
If no amicable solution can be reached, customers may refer the matter free of charge to a consumer mediation service, in accordance with the provisions of the French Consumer Code, or bring the matter before the competent courts as provided by applicable law.
